Ex-finance chief charged in $10.7M Arizona company embezzling scheme

A former finance director used an Arizona-based software company as a personal piggy bank for roughly $11 million and has been prosecuted federally, according to court documents obtained by Arizona’s Family on Thursday.

According to federal authorities, Mark David Latham was the finance director for Performance Software Corporation from March 2009 to roughly January 2025, and he exploited the company’s bank account to pay for his personal credit card charges.

He is accused of stealing over $10.7 million in total. According to court documents, Latham spent the embezzled money on common purchases. But one major purchase was $38,939 from Vivid Seats for Super Bowl LVII tickets in Glendale.

According to investigators, on Jan. 30, 2023, he used the company’s bank account to wire two payments totaling $40,000 to his Chase credit card to cover the majority of the ticket costs.

Latham was charged with a single count of wire fraud. If convicted, authorities plan to seize his property to recoup what was stolen.

Because this is a federal matter, a photograph of Latham was not readily available.
