‘She’s in there’: Man stores ex‑girlfriend’s severed head in a ‘carry-on’ suitcase with a flower, says he killed her after she played him ‘like a sucker’ and ‘fool’

A New York man confessed to killing his ex‑girlfriend, dismembering her, and stuffing her remains,including her severed head,into a carry‑on suitcase that also held a flower.

“She’s in there,” 50‑year‑old Damon Foy whispered to detectives as they searched his Kerhonkson home after his 44‑year‑old ex‑girlfriend, Alberta Dale, vanished in April 2024.

He told investigators, “I killed her,” prosecutors say, citing court filings.

Last week, Foy pleaded guilty to murder after police uncovered Dale’s remains in his apartment on April 3, 2024. The day before, her cellphone and personal items lay by the roadside, discovered just one day after her family filed a missing‑person report and requested a welfare check at Foy’s residence.

Prosecutors estimate that Foy killed Dale between March 31 and April 1, 2024. He acknowledged to officers that the pair argued after their breakup, and that Dale ultimately forced him out of the apartment.

He also faced accusations of prior domestic violence, including a gun‑related incident that resulted in an active protective order at the time of Dale’s death.

During a police interview, Foy told investigators, “I loved her,” and then continued, “The only thing she kept doing … play me like a fool, play me like a sucker, and just took advantage of the whole f,ing system. That’s it. I was told to leave my own home. I was told to leave my own f,ing home, and I was told to leave my own f,ing home. Get out. Then it all started coming clearer to me.”

He added, “You know what it was like being told once again, not this time by the judge, but by her, to get out the house? Get out. And I ain’t got no choice to go back.”

On April 1, 2024, officers visited Foy’s apartment to look for Dale, finding only her empty car on the premises. The following day, they returned to question Foy after locating Dale’s phone.

Investigators uncovered the suitcase holding Dale’s remains in a closet and later obtained a warrant to open it. Police noted that “it appeared it was quite heavy for the size of the bag.”

After setting the suitcase on the floor, officers shone a flashlight on it and “immediately noticed what appeared to be dried blood,” prosecutors report.

Prosecutors state, “Officers opened the defendant’s suitcase and found Alberta Dale’s partial dismembered remains, including her severed head.” They added, “The remaining portions of her dismembered body were not located during the execution of the search warrant.”

Investigators recovered bone and tissue fragments scattered across Foy’s apartment, as well as pruning shears, a serrated knife, and an axe. Blood evidence was also present.

Prosecutors note that Dale ended the relationship, and she had previously told a crime‑victims unit, “if she went missing it was because [Foy] killed her,” according to court filings.

Under his plea deal, Foy faces a sentence of 23 years to life in state prison,two years shy of the maximum 25‑year‑to‑life term, prosecutors say.

Chief Assistant District Attorney Liz Culmone‑Mills told the Daily Freeman that Dale’s family backed the agreement.

“The District Attorney’s Office would not be making this recommendation were it not for Alberta Dale’s family,” Culmone‑Mills said.

Foy’s sentencing is set for December 16.
