Law enforcement’s months-long search for a suspect implicated in a fatal crash in Montgomery County came to an end last week.
According to Indiana’s public court reporting system, a warrant for the arrest of Andre Kerley, 37, was served on Thursday. Kerley’s arrest warrant was issued in November 2025.
Kerley was wanted for his alleged involvement in a 2024 crash in Montgomery County that killed Emily Johnson.
According to previous reports, Johnson was a passenger in Kerley’s Honda CR-V while driving on U.S. Highway 231 on October 27, 2024. Johnson was killed after Kerley allegedly pulled in front of a 2006 Freightliner RV, causing a collision.
According to an affidavit for probable cause filed with the Montgomery County Prosecutor’s Office following the crash, many witnesses stated that the RV’s operator had no control over the collision with Kerley and Johnson.
Johnson’s CR-V was heavily damaged on the passenger side during the incident. Kerley was also hospitalized due to injuries received in the incident.
Following the crash, investigators secured a search order for Kerley’s blood. A subsequent toxicology report found that Kerley had Delta-9 THC in his bloodstream at the time of the crash.
Police also discovered a glass smoking apparatus with what appeared to be marijuana inside the CR-V. They also found a little black container with a marijuana leaf sticker in the car.
Following the collision, Kerley was charged with the following:
- Causing death when operating a motor vehicle while intoxicated — a Level 4 Felony
- Causing death when operating a motor vehicle while intoxicated by a Schedule I or II controlled substance — a Level 4 Felony
- Reckless homicide — a Level 5 Felony
- Possession of marijuana — a Class B Misdemeanor
- Possession of paraphernalia — a Class C Misdemeanor
The charges in Kerley’s case were not filed until November 3, 2025, – than a year after the tragedy. It’s unclear why it took more than a year before Kerley was charged.
According to Indiana State Police, when Kerley’s arrest warrant was filed last week, he was already in the Marion County Adult Detention Center. According to Marion County jail records, Kerley was booked into the ADC on September 6.
No other information on what prompted law officers to book Kerley into jail on September 6 has been released.
According to jail records, the Montgomery County Sheriff’s Office seized Kerley. According to jail records, Kerley’s primary city of residence is Indianapolis.
Kerley was in court for a hearing on Monday. His bond was originally set at $4,000 cash.
However, at Monday’s hearing, an order was issued to enhance Kerley’s bond. According to Montgomery County Jail records, his new bond is $8,000.

Before the Montgomery County incident, Kerley had two prior memorable encounters with law police.
According to a 2022 WUFT story, Kerley was arrested for impersonating a University of Florida police officer. According to the Chicago Tribune, Kerley was arrested on identity fraud charges in Illinois in 2018.
