The Commonwealth’s Attorney for Virginia Beach, Colin D. Stolle, stated that Tyler Lynn Davis, 26, has been sentenced to 58 years in prison. This sentence comes after his conviction for attempted aggravated murder of a law enforcement officer. Davis was also sentenced for using a handgun, grand larceny, and conspiracy to commit grand larceny.
Circuit Court Judge Tanya Felton presided over the three-day jury trial and handed down the sentence. Davis received a total sentence of 93 years, 35 of which were suspended, for an active term of 58 years.
Davis was found guilty of these charges on October 24, 2025. On December 15, 2025, he also pleaded guilty to possessing a handgun as a convicted violent criminal.
The incident occurred on October 20, 2023, at the Kohl’s department store at Pembroke Mall. The Commonwealth produced evidence indicating that Davis, Jaclyn Anderson, Hayley Fernandes, and Brandon Foster arrived at the scene with the purpose of stealing merchandise.
Davis and the two women packed shopping carts with clothing, shoes, and luggage. Foster waited in a van in the parking lot to help them escape.
A loss prevention officer noticed the action and alerted law enforcement. Davis exited the building through a fire escape entrance while store employees sealed the exits. A Virginia Beach Police Department officer arrived at the scene in a marked vehicle with emergency lights engaged.
Davis fired three shots at the officer as he exited the vehicle. One gunshot impacted the police vehicle, but the officer was uninjured.
Davis fled on foot down Virginia Beach Boulevard. Police officers pursued Davis until they captured him outside a restaurant in the Town Center neighborhood.
Officers discovered the handgun on a median along the direction Davis went. During a subsequent interview with detectives, Davis admitted to stealing, shooting at the officer, and fleeing the scene.
Anderson, Fernandes, and Foster, the co-conspirators, were also convicted in connection with the incident. Davis has prior convictions for burglary, theft, receiving stolen property, narcotics possession, and fleeing police.
The prosecution was led by Deputy Commonwealth’s Attorney Janeé D. Joslin and Assistant Commonwealth’s Attorney Brandon C. Emery.
