A Houston-area man was sentenced to 45 years in prison after being convicted of driving while intoxicated for the seventh time, according to Comal County officials.
Brian Cooper, 41, of La Porte, pled guilty in Comal County to driving while intoxicated with three or more prior convictions, according to court documents.
According to the Comal County District Attorney’s Office, Cooper “was punished as a habitual offender,” as he had six previous driving while drunk convictions in Harris County.
Cooper was arrested on October 29, 2024, after being discovered napping in his truck parked in the northbound lanes of Loop 337 in New Braunfels, according to the Comal County District Attorney’s office. Cooper awoke after authorities tapped on his window, and his truck slid forward, colliding with a police vehicle positioned in front of him, according to the district attorney’s office.
Cooper’s pickup contained two alcoholic beverage containers, and he smelled of alcohol and staggered after exiting the vehicle, according to the district attorney’s office.
According to a blood test acquired by a warrant, his blood alcohol level was 0.182 grams per 100 milliliters of blood, more than double the legal limit of 0.08. Cooper was “uncooperative and had to be restrained” during the blood draw, officials stated.
