An apparently normal traffic stop in Saddle Brook on Thursday morning turned into something out of a crime drama when officers discovered that both passengers in a black 2020 Lincoln SUV were wanted for extradition from other states, according to authorities.
According to the Daily Voice, Saddle Brook police stopped the Lincoln at 11:23 a.m. on June 4 and identified the occupants as Sena Miclescu, 29, of Newburgh, N.Y., and Edera Miclescu, 27, of Baltimore, Md. Officers later determined that the identification documents offered during the stop were fraudulent.
Police told the outlet that Sena was wanted on full extradition warrants from Las Vegas, Oakland, and Alameda County, California, while Edera was wanted on a full extradition warrant from Las Vegas. Both were charged in New Jersey with third-degree felonies for allegedly presenting fraudulent documents and obstructing arrest and were remanded to the Bergen County Jail pending a first appearance in Central Judicial Processing Court in Hackensack.
Interstate extradition is the formal process by which one state requests that another surrender a person charged with a crime. The U.S. Constitution and federal statutes establish the framework for how that handoff occurs. Under 18 U.S.C. Section 3182, a demanding state can obtain a governor’s warrant. Once approved, custody transfers are normally conducted, according to the Legal Information Institute.
If Nevada or California decides to proceed with formal extradition in this case, officials in New Jersey may continue to keep the Miclescus until agents from those jurisdictions arrive to take custody.
According to the Daily Voice, Sena Miclescu was charged with third-degree willfully displaying a forged government document and third-degree impeding apprehension.
Edera Miclescu is charged with third-degree willfully showing a fraudulent government document and delaying apprehension, as well as third-degree counterfeit marks. Both suspects are still in the Bergen County Jail and will be processed at Central Judicial Processing Court in Hackensack for their initial court appearances.
The Saddle Brook Police Department’s public website provides contact information, leadership information, and alert options, and people are encouraged to report suspicious activities through its outreach channels. The initial account of the incident contained a photo credited to the Bergen County Sheriff’s Office, and local officials have not provided any additional public information beyond the arrests and decision to remand the offenders.
Both suspects are presumed innocent until they are found guilty in court. Any extradition petitions or new charges will have to go through the standard processing and judicial hearings in the coming weeks.
